Supreme People’s Court Publishes Second Batch of Guidance Cases

The Supreme People’s Court has published the second batch of guidance cases. Among

them, there are two administrative and two civil cases, with serial numbers 5-8. Case

number 5 emphasizes that if a licensing requirement or penalty under local government

regulation violates the law, the People’s Court should not follow it in administrative trials.

The SPC published the first batch of guidance cases with serial numbers 1-4 on

December 20 last year.

Tidying in Nuptial Agreement

Ms. Hu had divorced Mr. Zhang once by reason of the latter having an extramarital affair.

After the two remarried, Zhang still maintained his relationship with the third-person, Hu

therefore filed for divorce again. Under mediation conducted by the Beijing Miyun

County People’s Court, Hu withdrew the lawsuit. However, the mediation agreement

stipulated that Zhang’s household responsibilities would include buying breakfast for the

family at least three times per week, doing laundry once per week, tidying bedroom every

day, accompanying Hu to shop for one hour each week, and spending at least half an hour

with their child each day etc.
