Jining, Shandong Intermediate People’s Court Rules that Grandparents Have the Right to Visit their Grandson

The plaintiffs were an elderly couple, whose son, Mr. Zhang, married the defendant, Ms. Wang, and had a son. Afterwards, Mr. Zhang passed away due to illness. In 2008, Ms. Wang remarried, and the son lived with Ms. Wang.

Due to various reasons, Ms. Wang refused to allow the two plaintiffs to visit their grandson. The plaintiffs consequently filed a lawsuit, requesting the right to visit their grandson at any time. In the court’s opinion, the two plaintiffs’ request was legitimate under “The Marriage Law of PRC” and the two were among the subjects with visiting rights.Otherwise it would be against both the public order and moral custom.
