On 20 of July 2010, Shu Jiangrong, a judicial functionary in Haiyan County, was fined by

the Haiyan County traffic police brigade for driving through yellow light. Shu believed

that the fine was collected from him without legal basis; hence, after failing in

administrative reconsideration, he initiated China’s first administrative litigation case of

‘Driving through Yellow Light’ on September 26, 2010. On September 26, Shu lost in

the first instance and on April 6, the Jiaxing City Intermediate Court made a final

judgment that the first instance verdict was to be maintained.

This case concerns the interpretation of Article 38 of the “Regulation on the

Implementation of the Road Traffic Safety Law of the People’s Republic of China”,

which stipulated that when the yellow light is on, vehicles which have already passed the

stop line can continue on driving. According to reports, driving through yellow light is

not considered violation of this Article in Beijing and Guangdong, whilst in Jiangsu,

Shandong and Hubei, driving through yellow light will receive the same penalty as

driving through red light.

Chen Jie, citizen of Liaoning Province Anshan City Tiexi District, disclosed on the

internet that when she and another five petitioners went to Zhang Guoliang, Tiexi District

Bureau Chief for Letters and Calls, for relieve against forced demolition, Zhang told

them that they must cooperate even if the authorities asked them to be raped, let alone in

cases of forced demolition.

Chen said that the rogue-like Bureau Chief had a successful career as government official

and was recently promoted to be District Head Assistant.
