The Nation’s Model Court with Recognized Jury System: The Rhetoric Does Not
Match the Reality
In all jury trials in Liuyang Municipal Peoples Court, one of the nation’s model court
with recognized jury system, the trial judge is required to ask, “Does any of the jurors
wish to express an opinion?” before pronouncing a judgment. Lu Guangzheng was one of
the first batch of eighteen jurors hired by the Liuyang Municipal People’s Court. At the
very first trial that Lu served as juror, which involved a charge of armed robbery made
against a minor defendant, he stood up and expressed the opinion that, owing to the
defendant’s age, “he should not be sentenced too harshly, instead the court should devise
a sentence that emphasizes education and rehabilitation.
