Shan County People’s Court Judge Gave a Light Sentence on Ground of Eyes
Dazzled
In September last year, Zhang Liqiang’s passenger car was rolled by a heavy truck from
behind, causing the instant death of three people including Zhang’s wife and daughter.
Two people were injured. On December 27, Shan County People’s Court sentenced Y ang
Xinhua, the defendant who was fully responsible for the accident, with two-year
imprisonment. However, the victim Zhang Liqiang was not provided with the judgment
and has to ask for a copy of which from the court through a lawyer.
According to law, the defendants in such cases shall be sentenced to more than three
years but less than seven years of imprisonment. The court gave a light sentence in this
case on the ground that the defendant voluntarily paid more than 900,000 RMB as
compensation. Yet Zhang said he has never received any compensation from the
defendant.
Shui Tao, the Presiding Judge of this case, admitted that the criminal aspect of this case
was heard by Shan County People’s Court and the civil aspect by Sanmenxia City Hubin
District People’s Court, and that the light sentence was given according to the proof of
compensation provided by the Hubin District People’s Court. Di Ermin, the judge of
Hubin District Court, stated that he provided a “proof of compensation” only because the
Shan County People’s Court required it and that he just wrote on the proof that “the
defendant said he will pay 900,000 RMB.” Shan County People’s Court obviously forged
the proof. To this, Shui Tao explained that his eyes were dazzled” at that time.
